Homes in Loreto declares and acknowledges that, in every commercial transaction involving the sale of land or homes, its CLIENTS (hereinafter referred to as “the consumer” for the purposes of this document) enjoy the following RIGHTS:
- To receive truthful, clear, and up-to-date information and advertising regarding the property offered, regardless of the medium through which it is communicated, including digital platforms, in such a way that allows the consumer to make the best purchase decision, fully informed about the characteristics of the property they are acquiring, in accordance with the provisions of the Law.
- To be informed about the relevant characteristics of the property, including: land area, construction, type of structure, installations, finishes, parking space, use of common areas, available services, and the general physical condition of the property.
- To freely choose the property that best suits their needs and purchasing power, without any imposition by the seller.
- Not to make any payment until there is written evidence of the contractual relationship, except for payments related to deposits or operational expenses, in the terms provided by the Federal Consumer Protection Law.
- To sign an adhesion contract registered with the Federal Consumer Protection Agency, in which the terms and conditions of the property sale are clearly stated. The seller is obligated to provide the consumer with a signed copy of the contract after it has been executed.
- To acquire a property that complies with the safety and quality standards established by the applicable regulations and reflected in the information and advertising provided by the seller.
- To receive the property within the timeframe and under the conditions agreed upon in the respective adhesion contract.
- To exercise the warranties on real estate provided for in the Federal Consumer Protection Law, in accordance with the specifications outlined in the relevant adhesion contract.
- To receive the appropriate compensation or indemnification in accordance with the Federal Consumer Protection Law, should defects or issues with the property persist after the warranty has been exercised. Likewise, to demand necessary repairs for defects attributable to the seller, or, where appropriate, to opt for the replacement of the property or the termination of the contract when legally applicable.
- To have access to free and accessible mechanisms and channels for consultations, requests, complaints, and suggestions, as well as to know the address designated by Homes in Loreto to receive notifications.
- To the protection of competent authorities in accordance with applicable laws, including the right to file complaints and claims before such authorities.
- To be provided with a Privacy Notice that informs them about the handling of personal data provided and, where applicable, to consent to its use; and for their personal data to be processed in accordance with applicable regulations, with the right to exercise their Access, Rectification, Cancellation, and Opposition (ARCO) rights.
- To receive non-discriminatory treatment, without being denied or conditioned to receive services or purchase a home based on gender, nationality, ethnicity, sexual preference, religion, or any other characteristic, in accordance with applicable legislation.
- To freely choose the notary public responsible for formalizing the corresponding public deed.
